Unbelievably, the U.S. Senate voted to suspend habeas corpus for prisoners at Guantanamo, effectively giving the White House free rein. Even if confirmed by the House, this does not stand much chance of being found constitutional:

“The privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.” — U.S. Constitution, Article I, Section 9
