Common Sense and Other Impossibilities

A few simple legal changes could help. Establish penalties for violating the constitution. Actions like arresting a journalist for being there, or tear-gassing peaceful protesters, are unconstitutional, but the usual legal response, if it gets that far, is to be scolded “Don’t do that!” Also provide incentives to try police for their wrongdoings. If an arrestee can credibly allege official misconduct, perhaps as determined by the trial judge, then do not allow the arrestee’s trial to complete and return a verdict until the trial of the officials has completed.

If the arrestee’s allegations turn out unfounded, that can be taken into account when their trial resumes. Everyone has incentive to behave well.
